Terms & Conditions

These Terms and Conditions govern your use of the services offered by Masakhane Group (Pty) Ltd (Registration No. 2010/0111145/07), trading as Masakhane FET College and its associated entities, with registered offices at 50 Circuit Road, Westmead, Pinetown, KwaZulu-Natal, 3610 ("Masakhane", "we", "us", or "our"). By enrolling in any course, using our online portal, or making a payment through our website, you agree to be bound by these terms.

1. About Masakhane Group

Masakhane Group is a TETA-accredited training provider (Accreditation No. TETA13-341, valid to 30 June 2028) and a QCTO-accredited training centre. We deliver accredited programmes in transport and logistics, occupational health and safety (OHS), forklift and lifting machinery operation, dangerous goods (HAZCHEM), fire fighting, business skills, and ISO consulting across KwaZulu-Natal and nationally.

2. Enrolment and Registration

2.1 Enrolment in any programme is subject to availability and acceptance by Masakhane. Submission of a registration form does not constitute a confirmed booking.

2.2 You must provide accurate, complete, and current information during registration. Masakhane reserves the right to cancel an enrolment if fraudulent or incorrect information is provided.

2.3 Certain programmes carry prerequisite entry requirements (literacy level, prior learning, valid licences, medical fitness, etc.). It is your responsibility to ensure you meet these requirements before enrolling.

2.4 Enrolment is confirmed only upon receipt of full payment or an approved purchase order from a corporate client.

3. Fees and Payment

3.1 All fees are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable.

3.2 Payment is processed securely through PayFast, a third-party payment gateway. By making a payment you also agree to PayFast's terms of service. Masakhane does not store your card or banking details.

3.3 Full payment is due before the commencement of training unless a written credit arrangement has been agreed upon with management.

3.4 Corporate clients may be invoiced under agreed terms. Interest may be charged on overdue invoices at the prime lending rate plus 2% per annum.

3.5 Masakhane reserves the right to amend its fee schedule at any time. Price changes will not affect confirmed and paid bookings.

4. Course Delivery and Attendance

4.1 Masakhane will make reasonable efforts to deliver programmes as scheduled. We reserve the right to reschedule, cancel, or modify a programme due to insufficient enrolment, facilitator unavailability, force majeure, or any other circumstance beyond our reasonable control.

4.2 Learners are required to attend all scheduled sessions. A minimum attendance threshold (typically 80%) applies for accredited programmes. Learners who do not meet the attendance requirement will not be eligible for certification.

4.3 Learners are expected to conduct themselves professionally and respectfully at all times. Masakhane reserves the right to remove a learner from a programme for disruptive or inappropriate behaviour without a refund.

5. Certification and Assessment

5.1 Certificates are issued upon successful completion of all required assessments and attendance requirements. Masakhane does not guarantee certification where a learner has not met the prescribed competency standards.

5.2 Certificates of competence, attendance, and completion remain the property of the learner once issued. Digital certificates are available via the Masakhane online portal.

5.3 Re-assessment fees may apply where a learner is required to repeat an assessment following an unsuccessful attempt.

6. Intellectual Property

All course materials, manuals, assessments, and digital content provided by Masakhane remain the intellectual property of Masakhane Group (Pty) Ltd or its licencors. You may not reproduce, distribute, or resell any course materials without prior written consent.

7. Limitation of Liability

7.1 To the maximum extent permitted by South African law, Masakhane shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services or reliance on any information provided.

7.2 Masakhane's total liability in connection with any claim shall not exceed the total fees paid by you for the relevant programme.

7.3 Training delivered by Masakhane is intended to meet regulatory compliance requirements. It remains the responsibility of the employer and learner to ensure that all workplace safety and legal obligations are met.

8. Privacy

Personal information collected during registration and payment is processed in accordance with the Protection of Personal Information Act (POPIA), Act 4 of 2013. We collect only the information necessary to deliver our services, and we do not sell your personal information to third parties. For more information, contact us at info@masakhanegroup.co.za.

9. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of KwaZulu-Natal.

10. Changes to These Terms

Masakhane reserves the right to update these Terms and Conditions at any time. The effective date at the top of this page will reflect the most recent revision. Continued use of our services after any change constitutes acceptance of the updated terms.
